1. About us
Made Better Digital provides website design, website redesign, website maintenance, digital optimisation, business automation, Google Business Profile services and related digital services.
These Terms & Conditions apply to services supplied by Made Better Digital to its clients.
2. Quotes and scope of work
The scope, price and deliverables of each project will be agreed with the client before work begins.
Website prices advertised as "from" prices represent starting prices. Final pricing may vary depending on the number of pages, functionality, integrations, content requirements and complexity of the project.
Any work requested outside the agreed scope may be quoted separately.
3. Payment
Payment terms will be stated on the relevant proposal, quotation or invoice.
Work may not begin until any agreed deposit or initial payment has been received.
Made Better Digital reserves the right to pause work or services where invoices remain overdue.
4. Website projects
The client is responsible for providing any information, branding, images, copy, login credentials and other materials reasonably required to complete the project unless otherwise agreed.
Project timelines may be affected if required materials or feedback are delayed.
Made Better Digital will make reasonable efforts to ensure websites function correctly on current major browsers and common device sizes.
5. Complimentary website concepts
Any complimentary website preview or concept is provided for demonstration purposes only.
A complimentary concept does not constitute a completed website and may contain placeholder content, imagery or information.
Made Better Digital retains ownership of unpaid concepts and designs unless otherwise agreed in writing.
6. Revisions
The number and extent of revisions included in a website project will be confirmed in the project scope.
Additional revisions or substantial changes outside the agreed scope may incur additional charges.
7. Website ownership
Once all amounts relating to a website project have been paid in full, the client will receive the agreed rights to the final website deliverables created specifically for them, excluding third-party software, fonts, libraries, licensed assets, platforms and other materials subject to separate licences.
Made Better Digital may retain reusable know-how, techniques, components and non-client-specific elements used in providing its services.
8. Third-party services
Made Better Digital may use third-party platforms and service providers for hosting, domains, analytics, automation, communications and other functionality.
Third-party services are subject to their own terms, availability and pricing.
Made Better Digital is not responsible for outages, changes, restrictions or failures caused by third-party services outside its reasonable control.
9. Made Better Care and Care+
Care subscriptions provide the services described in the client's selected plan.
Services may include hosting management, monitoring, technical maintenance, security monitoring, backups, content changes, support, performance monitoring and optimisation depending on the selected plan.
Subscriptions are billed monthly unless otherwise agreed.
Either party may cancel a monthly service in accordance with the notice period stated when the service is purchased.
10. Search engine optimisation
Made Better Digital may implement technical and on-page SEO practices designed to improve the accessibility and search-engine foundations of a website.
Search engine rankings depend on numerous factors outside Made Better Digital's control.
Made Better Digital does not guarantee specific rankings, traffic levels, leads or positions in search results.
11. Business automation
Automation services are configured according to the agreed project scope.
Automated communications and workflows may depend on third-party platforms, telecommunications providers and integrations.
The client remains responsible for ensuring its use of automated communications complies with applicable laws, consent requirements and industry regulations.
12. Client responsibilities
Clients are responsible for ensuring that information, claims, images and other content supplied to Made Better Digital are accurate and that they have the right to use them.
Clients remain responsible for their own business operations, regulatory compliance and customer communications.
13. Limitation of liability
Made Better Digital will provide its services with reasonable care and skill.
To the extent permitted by applicable law, Made Better Digital will not be liable for indirect or consequential losses, loss of profit, loss of revenue or losses resulting from circumstances outside its reasonable control.
Nothing in these terms excludes liability where it cannot legally be excluded.
14. Portfolio use
Unless otherwise agreed in writing, Made Better Digital may display completed publicly available work in its portfolio, website, proposals and marketing materials.
Clients may request confidentiality before work begins.
15. Termination
Either party may terminate ongoing services according to the cancellation terms agreed for the relevant service.
Outstanding fees for work already completed or committed remain payable.
16. Changes to these terms
Made Better Digital may update these Terms & Conditions from time to time. The latest version will be published on the Made Better Digital website.
17. Governing law
These terms are governed by the laws of the Netherlands.
Any disputes will be subject to the competent courts of the Netherlands, unless mandatory law provides otherwise.
